CONTRACT
GUYANA
COUNTY OF DEMERARA, BERBICE, ESSEQUIBO.
THIS AGREEMENT is made this…………………………………………………….day

THOUSAND AND………………….between…………………………………herein
after referred to “the student” of the First
Part, and the Permanent Secretary, Ministry of Education
of the State of Guyana acting herein for and on behalf of
the Government of Guyana, hereinafter referred to as “the
Government of the Second Part”.
Whereas the
Government, at the request of the Student, has agreed to
grant the Student an award to attend Cyril Potter College
of Education to pursue studies in Education leading to the
Trained Teachers’ Certificate with effect from August,
200… upon the terms and conditions following.
AND WHEREAS
THE GOVERNMENT agrees to pay the Student on the PRE-SERVICE
PROGRAMME a maintenance allowance only for two (2) or (3)
three years as the programme requires (For Per-service student
only).
AND IT IS HEREBY
AGREED AND DECLARED by and between the parties as follows:
1.To apply himself/herself diligently and continuously to
the aforesaid course of studies;
2.Not without
the approval of the government being first had to apply
himself/herself to any studies and/or courses except that
mentioned above;
3.Not to absent
himself/herself from classes for prolonged period without
the written authorization of the Ministry of Education;
4.To report to
the Ministry of Education during the long vacation period,
if so requested, and to carry out such tasks as may be assigned
to him/her;
5.To report to
the Ministry of Education immediately after the completion
of the course for instructions regarding placement;
6.To accept employment
with the Government or agency approved by the Government
at such remuneration as the Government may determine for
a continued period of at least FIVE YEARS, such employment
to be offered to student (within four months from the date
of his reporting of duty), failing which the student may
be relieved of this obligation under this agreement;
7.Not to conduct
himself/herself in manner, which the Government deems to
be inimical of its interest;
8.To abide by the current Training Rules of the Ministry
of Education;
9.That in the
event that the student has taken up employment with the
Government or an employer approved by the Government, but
has not completed the period of service required under this
Agreement, and he/she wishes to leave Guyana for any reason
whatever he/she shall before the necessary travel arrangements
are made, notify the Ministry of Education of his/her intention
to leave Guyana and shall provide to the Government a suitable
surety or guarantor to stand responsible to the Government
for the repayment of any debts that may become due by the
failure of the student to return to Guyana and fulfil his/her
obligations under this Agreement. Provided that the Government
may waive the requirement of surety or guarantor if he is
satisfied that the purpose of the Student’s leaving
Guyana is to attend an approved course or seminar and that
the Student intends to return to Guyana;
10.In the event
that the Student’s academic performance/conduct is
deem unsatisfactory by the Principal, unless a reasonable
explanation is given by the student to the Government for
such performance, the Government may withdraw the award
and terminate the total amount paid out by the Government
in pursuance of, or incidental to, this Agreement, such
monies to be a debt due by the student to the Government
and to be recoverable by law;
11.That any breach
of the above will render him/her to refund to the Government
the entire sum accumulated for tuition (as well as the value
of grants received during training and interest accrued)
(for Pre-Service Student only) in pursuance of this Agreement
such sum to be dept due by the Student to the Government
and to be recovered according to law;
12.That this
sum is likely to increase as salaries and grants increase.
